General information

The current attributions of the Prefect Institution are to be found in the Romanian Constitution, Law nr. 215/2001, Law of local public administration, Law 340/ 2004 regarding the Institution of the Prefect, Law 181/2006 regarding the approval of OUG 179/2005 to modify and complete Law 340/2004 regarding the institution of Prefect and HG 460/5 April 2006 for unitary application of norms summed in Law Legii 340/2004.

Respecting the Romanian Constitution
Art. 123 The Prefect
(1) The Government shall appoint a Prefect for every county and the city of Bucharest.
(2) The Prefect is the respresentative of the Governement on local level and head of deconcentrated ministry public services and belonging to other organs of central public administration from the territorial-administrative units.
(3) The attributions of the prefect are defined in a organic law.
(4) There are no subordination relationships between prefects on one hand, anhd local councils, mayors, and county councils and their presidents on the other.
(5) The Prefect can start a procedure in the administrative courts to stop any document adopted by the county council, if considered illegal. That document will be suspended.
